Delaware Department of Justice’s Actual Innocence Program
Description
The Delaware Department of Justice's Actual Innocence Program was established to investigate wrong convictions. Staff within the office are tasked with ensuring that all claims of innocence are properly investigated, and that individuals who are able to offer strong evidence of wrongful conviction are exonerated. The Actual Innocence Program operates separately from subdivisions of the Delaware Department of Justice that consider requests for clemency, review appeals and investigate claims of injustice other than wrongful conviction. In order to have a case reviewed by the Actual Innocence Project, individuals must be currently incarcerated and must offer scientific evidence of their innocence. This may be new evidence or evidence that can now be tested using new technology. All applications for review must be submitted either by mail or using the electronic format described on the website.
