One of Oklahoma's Indigent Defense System's (OIDS) Capital Trial Division is located in Sapulpa, OK. This division is led by a Division Chief and a Deputy Division Chief that serves indigent clients in Creek County. The Capital Trial Division is responsible for handling all death-sentenced defendants resulting from lawsuits filed against indigent clients. The system is appointed by the courts to represent all adult and juvenile indigents in 75 counties who are charged with a felony, misdemeanor and traffic cases punishable by incarceration. The courts further appoint the system to represent all indigents in 75 counties where the State is seeking the death penalty. The system does not represent defendants charged in Oklahoma and Tulsa counties, nor does it handle civil, juvenile proceedings such as juvenile deprived cases or termination of parental rights proceedings. District court judges determine whether a defendant is indigent by applying standards developed by the Oklahoma Court of Criminal Appeals. The defendant fills out a form about their assets, liabilities, and sources of income. If the judge determines the defendant is indigent, OIDS is appointed.
