Description
The Commonwealth of Massachusetts Conviction Integrity Unit investigates all claims of innocence filed under its jurisdiction. The first step in the review process requires that the unit establish eligibility. Only those cases which relate to currently incarcerated individuals serving time as a result of conviction in the Commonwealth of Massachusetts are eligible for review. Additionally, petitioners must clearly substantiate their claims of innocence through the presentation of novel evidence not previously considered by the court or by demonstrating how new technologies allow for more thorough testing of existing evidence. The Conviction Integrity Unit provides a thorough and unbiased investigation into all credible claims and makes recommendations to the state's attorney whenever necessary. Though their primary concern is with claims of innocence, the unit will also investigate other claims of wrongful conviction and excessive sentencing. However, they cannot review claims related to individuals already released from prison or those whose cases are under review in Appellate Court.
